Land to rear of Lark Rise/The Avenue

A guy has been in the field (currently planted with maize) today blocking up the gates to properties along Lark Rise and The Avenue which have access to the field but have not responded to a recent letter from Ashville Properties Limited asking property owners to confirm they have no right of access to the field. He said this is advance of development. My research with Hampshire has only revealed an application to provide allotments. Does anyone else have any more information?

This is very interesting Sylvia, as it may well be that the anyone who has a gate giving access to the field and has used their gate to gain access to the field, could possibly now have acquired certain rights.
I understand that there is a prescribed period of time, which if the access was used without objection from the owner of the field, then the person (s) using the gate to access the field would now have established the right to go onto the field.
One more point, if residents have used the field for a period of time without objection, I understand that there is a process whereby the residents can take action to have the field declared a village green !
Wouldn t that be nice ?
What is needed is for all the residents to get together, and maybe take advice from a tame solicitor

Perhaps the developers will take this opportunity to update us on their intentions with regards the planning application for the Lowsley Farm site. The Lowsey Farm website has not been updated since January.
It would be particularly interesting to hear what notice has been taken of the feedback received from local residents during the consultation.

The period of time required for adverse possession is 10 years. However, it as not as easy as you think and a person would have to establish that they have maintained the land by eg mowing the grass, tending to flowers, cutting trees etc.
The period of time required for the doctrine of prescription is 20 years. The property owners in Lark Rise and the Avenue that back on to the field would have to establish that they, or previous owners and occupiers, have crossed the field as a footpath for 20 years. If this is the case, a right of way will be presumed to have been granted.

To the Parish Council or EHDC, what infrastructure improvements can we expect with this? 155 more houses, at least 300 new residents and potentially 150-300 more cars. Liphook has taken a big share of new housing wihout any infrastructure inprovements and this is certainly not sustainable unless we have more jobs, business opportunities and services improvements to match the demand that even more new household will impose. And I am not just talking about a new cycle path like the one we were so generously given when the Bramshot place building was completed.
