Motor cyclist
- Carole (23rd Jan 2021 - 12:38:11)

The motor cyclist who rode in the woods on private land by wheatsheaf enclosure this morning, please keep to the main track. You will know who you are because you had to stop to let 2 people through. What you wouldn’t have known as you entered the private wood was that the race horses were on the gallops. There is not right of way through this private wood.

Carole - you are not the only one sick and tired of this blatant disregard of private property. If you are aware of anyone trespassing, the police have told us to ring 999 as it is a criminal offence. There is a rural crime unit aware of the problem so the more often the activity is reported, we might get on top of it. But we need people to get on board and do this rather than turn a blind eye. Motorised vehicles are not allowed on restricted byways or footpaths.

Tony,

Trespassing is a civil matter, and is not a criminal offence in itself. However, this could be categorised as aggravated trespass which is a criminal offence.

More info can be found here: netpol.org/law-and-occupations/#7

Wrong here James. Police have asked us to call 999 as this local trespass by increasing numbers of vehicles is criminal as it is a) damaging livelihoods b) damaging the environment c) often intimidating d) causing danger to life where riders on horseback are involved. Basically shite activity however you look at it.

Re: Motor cyclist

Tony, please read my post properly. It will be aggravated trespass not just trespass. Trespassing isn't a crime in itself it is a civil matter.

Please look at the CPS website: cps.gov.uk/legal-guidance/...

AND The Criminal Justice and Public Order Act 1994: Section 68

Aggravated trespass is illegal and can result in a prison sentence and/or a fine.

If you and your mates are the trespassers James, be very careful. You might think you're the smart one quoting this that and the other, but there's two parties to every crime. Law or not law, invading other people's property can never be morally right. Can it?

Re: Motor cyclist
- James (24th Jan 2021 - 10:43:02)

Tony,

I am not involved in this matter, and I am not the trespassers. I do agree that this is not okay, however it is the language you use that needed correcting.

Stop arguing chaps. He should not have been on his motor bike in that area but he isn’t the only offender hence why Shufflesheep plantation ( private land) is now barbed wired off.
Highfield school have private notices in the woods opposite but they are blatantly ignored most weekends.
The Sussex border path is a restricted byway but is used by a lot of vehicles, access only . But access to where? The units at north lodge farm, golf course, wheatsheaf enclosure, hollycombe at one end, Milland at other end! No problem with that but not used as a joy run, race track.
