BMW - LD62 WVF

You might have only been nipping into the parish offices but you are clearly not disabled so did you really need to park across BOTH disabled parking spaces in the Midhurst Road car park.

Seriously - what are the legalities of you posting this picture? Leaving the issue aside, do you have their permission? Do you need their permission?

What if there is a valid reason for this? Hypothetically, lets say they are a doctor parking in a hurry to attend to an emergency - what then?

Editor - you need to start providing rules on the naming and shaming on this website!

Granted, it might not be the best parking ever, but to say they are taking up two spaces is pushing it!! True, their rear tyre looks like it’s on the line, but the other space is clearly still usable. It’s also worth remembering that not all disabilities are visible! On the other hand it could be an inconsiderate driver, swinging into a disabled space, out of pure convenience, which would be wrong. But do you actually know this??? Or are you just making a massive assumption, based on little fact?? For the record I have no idea who’s car this is, but sweeping assumptions and the ‘name and shame’ nature of this post, sadden me, unless of course you do have any facts on which to base your post on?

Did the person not display a blue badge or are you making the assumption they were not disabled? Not all disabilities are visible but can be equally debilitating.

These bays are designed for disability mini buses as well as cars so even though this selfish person has only just parked across both bays this would have been a significant inconvenience if a mini bus carring disabled people arrived whilst this car was here. The bays are designed to enable easier manovourablity for those who have mobility issues so there really are no excuses for such inconsiderate behaviour

Paul - what legalities do you think apply? Car was in a public car park, accessed by public high way and registration numbers are not private data. We now live in a world with far more visibility and public scrutiny so if you are going to behave in a anti social or inconsiderate way the consequences can be more embarrassing.

For the record, I saw this guy arrive, he was not disabled, no badge, just selfish. The car park was half empty, he was just too lazy to park properly, he was obviously just dropping an envelope off to the parish offices and stopped for a natter, oblivious no doubt to the fact that if a genuine disabled car driver or mini bus driver had turned up they would not have been able to park in the area reserved to them. I did wait to speak to him but felt it was not appropriate to confront him in within the parish offices. However he was inside sufficiently long enough that I did not have the time to wait.

@ I - don't get me wrong, I too would be hacked off if this is inappropriate use of accessible parking. But my concern is that you have posted identifiable material on a public website without that person's permission - and I am concerned that you might expose yourself legally in some way (and by identifiable I mean that with the registration you can find out their address).

I'm not a lawyer, I don't understand the law on this - but my gut instinct is to be very careful about identifying people in this way.

If the driver has so blatantly violated some parking rules, should you not instead be informing the relevant authorities to handle this (you have evidence) rather than posting it online?

I'm genuinely worried that someday this naming and shaming on Talkback is going to go badly wrong.

I can't see any problem with this. The whole point of registration plates is that they are public and recognisable.
This car was in a public area, therefore you are free to take photographs.
If the poster wants to put them up here and the editor is happy to publish them then that is their choice. If the owner of the car decides that he or she is being harassed or libelled then they can take action.

Paul I think your concern is misplaced. I'm pretty sure you do not need the consent of the perpetrator to expose their misdeed. Its not as if I am going to prejudice a criminal trial!

If the guy is shamed and embarrassed by this posting and does not park in disabled spaces again then Talkback has provided a useful community service

Trust this is not lawful despite your anger did you check to ensure no one else was in car as again that is an offence to photograph without consent I will not go in to detail but please be aware of rules

As the parking bays are only courtesy bays the driver has not committed any offence, no doubt some one will jump up and down but as there are not any blue signs these bays are not enforceable.

Interesting ! And confusing !

Being naturally curious I thought I’d check the legality out...

So pretty much fine and you own the copyright to your photo for 70 years. 😂 But I don’t think people will be queuing up to pay you for it - underexposed and not framed very well.

But then I clicked on the human rights link.
“No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honor and reputation. Everyone has the right to the protection of the law against such interference or attacks”

As someone pointed out, if it was a doctor attending an emergency they would be pretty peeved and there is reputational damage.

Conclusion: sometimes two nutty people come across each other in the world and cause chaos ! The BMW driver, who we know won’t be a doctor, for being silly - but representing the reputation BMW drivers have pretty well. (Sorry Col !). The original poster for being a teensy weeny bit anal when there are clearly loads of other spaces available and causing a drama out of nothing. There is much more important stuff to worry about in life !!!
