Google Checkout - be warned

Having just tried to return some goods under the 'Distance Selling' directive and having to make a claim against my credit card provider, I discover that I have fallen foul of the 'Google Checkout' - which I will never use again - and I would advise all of you doing online transactions not to use the 'Google Checkout' if a retailer gives you the option.

This is what my credit card company say....

"Unfortunately because you used Google Checkout to make your purchase, you do not have a valid claim against [card provider] under Section 75 of the consumer Credit Act 1974.

A purchase made using Google Checkout adds another party to the transaction. Section 75 of the consumer Credit Act 1974 does not apply to transactions where there are more or less parties involved than a Debtor, Creditor and a Suppier."

So be warned if use Google Checkout you forfeit your usual rights of protection when using a credit card.

Both Google Checkout and PayPal protect you from fraud, but it appears that using either would prevent you from using the consumer Credit Act for protection - for instance if the supplier went out of business before delivering the goods.

So, the safest method is to use a credit card directly with the supplier wth no intermediate 'provider' like Google Checkout or PayPal.

Thinking about it, a great many online retailers (most, maybe) use a third party organisation to process their payments.

It is entirely possible that most online transactions are not covered by the protection afforded by the consumer credit act 1974.

I don't suppose that this situation was intended/foreseen when the act was drafted.

This government has brought in over 3600 new pieces of legislation since it was elected. Perhaps it is time to start looking at some of the old ones.
