Pines Road

I had a reason to go down this road as I was picking up something. The pot holes and what looks like a sink hole are really bad and dangerous .

The residents need to do something about it before it becomes impassable to everyone including the emergency services

The potholes act as an effective traffic calming measure.
The deeper the better.

I'm sorry but living down the road its ruining our cars !! And is not effectively calming the 4 x 4 s that still speed over them I totally agree that the road should be properly made up as are the wants of the first 5 houses of the road but the others in the road refuse to let us .

Sounds like the usual predicament with living on a private road not maintained by the council.

if you can't work it out nicely, the question would be who legally owns the road not who uses it and are there deeds showing who has to maintain what, if so there would be a legal procedure you can follow to get the appropriate people to contribute

Hi Jennifer, out of curiosity I googled this and there's an interesting thread on moneySavingexpert you can cut and paste here;

It discusses a lot of the complex questions related to maintaining private roads it seems confusing, who may be responsible for what, it's a bit of a minefield and you may be best to speak to the CAB and get some free legal advice, because according to gov.uk if the road is unadopted responsibility lies with the 'frontagers' I've pasted the link below;

So you can see there's a bit of digging to be done to get to the bottom of this (no pun intended) maybe contact the local council to see what they think. Good luck.

Thank you for your information I most certainly will dig further as it is getting ridiculous cant walk the dog at night as you cant see where your walking and not sure I will be able to get a mobility scooter down there either now .

Pines road is an unmade road the pot holes are being caused by the wet weather not by any car be it a 4x4 or a small hatch back.this is a common problem with unmade roads.it is pointless in carrying out repairs to the road whilst it is so wet when it dries up I would be happy to arrange for road plainings to be delivered and laid but expect the other households in the road to help in filling the pot holes.this in the past has not been very forthcoming .road plannings are a temporary solution and would have to be repeated from time to time.to have the road tarmaced to a good standard would cost tens of thousands however if everyone chipped in the cost per household would not be so bad.in answer to one posting I do not recall being asked about repairing the road in the past.

Plannings have been put down on a regular basis and in the past the majority of the road have helped with this but as you say this only lasts for a short while as the vehicles either living or delivering in the road speed down the road and the plannings go flying in all directions!!! The road was paid for by the first 5 houses this time last year and it's worse than ever now we wanted to close the road for one day to scrape it all back and do a proper job but I believe we were threatened with legal action if we did that so although we paid a pretty penny it lasted a short while only

Mc I tried a few years ago everyone got a letter then last year my neighbour wrote to everyone are you new to the road ??

I stand corrected we did get a letter I am sorry I forgot this however I have had roads tarmaced at an industrial site owned by me and to do the job properly will indeed cost tens of thousands if people were to put money towards this then it must be done right and carried out by a road contractor not the local tarmac man.
Myself I moved to an unmade road fully prepared for what I was in for, tarmacing the road will for what it is worth in my view will encourage more and faster traffic up the road.
I offered road plainings by this I meant a lorry load not a wheelbarrow load I have access to both a roller and digger..
I was trying to help the situation but will now shut up and go away

Mc why didnt you suggest this when you got the letter rather than rant to my neighbour about it then !! We paid hundreds of pounds last year as the rest of the road wouldn't help !! No one will stop you helping with the road .when we moved here in 1999 there wasnt many cars in the road or deliveries and the road was ok .I am suffering now everytime I go out so anything would be appreciated as I dont want to become a recluse . Are getting the deeds from the bank to see what responsilibities we actually have to the road .I'm sure everyone hates it as much as I do .as cars are always parked at the end there is no where for visitors to park so we rarely get them

Jennifer did you manage to find anything out from the CAB? I suspect you are responsible for the frontage of your house to the middle of the road. If every house owner maintains their half of the road then all will be fine. Surely it won't cost much to buy a few bags of gravel and fill in the ones you're responsible for whenever they get bad? If you can't do that yourself for any reason I'm sure it wouldn't cost much more to have someone do it for you if it's your responsibility?

Just a thought, if a car is damaged by one of the potholes then they could within reason sue the property responsible for the pothole for any repair costs. If the holes are that bad then I'd suggest filling them in asap on that basis.
